Jilani Miya letter
3 August 2005
Respected Uncle Shaykh ul Islam Hazrat Allama Sayyid Muhammad Madani Ashrafi ul Jilani Sahib
Salaam and blessings
All Praise to Allah I am well. I hope that you too are healthy and safe. After the functions of the Urs of Makhdum ul Millat and after my final farewell greeting with you, I left for Lucknow. My health was in such poor condition that on arriving in Lucknow from Kichocha Sharif instead of going home, I went straight to hospital. I had planned a foreign trip on 28 August which I have had to cancel. At the moment by the grace of Allah I am well but after going to Kichocha Sharif again I became very weak.
Briefly, I want to state that on 19 March 2005 Saif Khaild came to my house at Arif Asiana and had a detailed discussion relating to the editors own views and my incomplete interview in the 7 March 2005 edition of India Today (Hindi), the Surat Spiritual Declaration and the Foundation for the Unity of Religions and Enlightened Citizenship (FUREC). At the time I telephoned you in Kichocha Sharif to inform you of this.
Respected Uncle, why is Saif Khalid knocking my head [hassling me] and without providing me with anything in writing seeking in haste a written repentance and retraction?.....My thoughts received increased strength when respected uncle Gazi e Millat Hazrat Allama Sayyid Muhammad Hashmi Ashrafi ul Jilani on his own volition came to my house in Arif Asiana and correctly guided me (by chance at this meeting there were several religious minded Islamic Scholars also present). The outcome was that respected Uncle Hashmi stated in the strongest possible terms that until you receive written notification you should not give at all costs any written document etc etc.
Respected uncle, up until today, I have been unable to comprehend [why it is] when he has his own Darul Ifta at Jame Ashraf in Kicchocha Sharif - if he felt this is the present time’s greatest and most difficult issue, then its responsibility should have been given to the Darul Ifta at Jame Ashraf. But in our own home surrendering quietly this unleashed Saif Khalid surely isn’t the work in the background to change what is clear and obvious into negative propagation? - ‘That my right is light in the distance’
Respected uncle, the anomaly of Saif Khaid’s insults, my character assassination and distorting my views is that I only received his written concerns after five months in July. To satisfy the Islamic and legal codes and regulations I have sent Saif Khaild a notice whose answer I await.
In relation to this, I am sending you the following documents: (1) India Today (Hindi) weekly dated 7 March 2005 and its urdu translation, (2) My explanatory letter to the editor, (3) Surat Spiritual Declaration and FUREC pamphlets with their urdu translations, (4) my letter to FUREC, (5) FUREC’s explanatory letter, (6) Saif Khalid’s distorted written views, (7) The notice I have sent to Saif Khaid.
Respected Uncle, in light of the existing positions and various backgrounds, for the sake of Allah, Faqir Ashrafi has decided to become a seeker of Islamic edicts to satisfy the Sharia and ensure administration of justice.
Allah willing, I will inform you of the ongoing discussions. On arriving in Ahmedabad give my salaams to respected Aunt. And prayers to brother Hamza Ashraf.
Seeker of prayers

SHAYKH AL ISLAM LETTER DATED 4 FEBRUARY 2006
Addressed to Head of Spiritual Foundation
I replied to your correspondence with a detailed letter addressing it in your name on 10 October 2005 and sent it to your address in Lucknow which you must have received; but as yet I have received no response from you. As of today, I am still waiting for a reply.
I have now reached a decision that for the sake of thoroughness and completion I speak with you face to face. For this reason, I have arranged a meeting to take place on 23 February 2006. Our discussion will take place Allah willing at ‘Zawiyatul Hamza’ in Kicchocha Sharif.
On the above mentioned date our discourse will start at 10.00am – this discussion will take place between you and I only – there will be no Mufti participating in the discussion from either side. However, if the off springs of Makhdum ul Millat Hazrat Mohaddis e Azam e Hind (blessings be upon Him) whether male or female and those who have a son in law relationship wish to attend and observe the proceedings they will be allowed to do so. If anyone who attends wishes to make a comment then this will also be allowed.
Anyone else who is not a member of the family of Mohaddis e Azam will not be allowed to attend or participate in the meeting.
Now it is compulsory for you to attend on the specified date and time at the above-mentioned location to discuss the matter with me.
Sayyad Muhammad Madani Ashrafi Jilani

Note: Allah willing a tape recorder will be provided so that the discussions are recorded.

Jilani Miya letter dated 9 February 2006
Respected Uncle Allama Sayyid Muhammad Madani Ashrafi Jilani Sahib
Salaam and Blessings
Faqir Ashrafi for the declaration of truth states that any fundamental Islamic belief and principle being merged in any meaning or understanding whatsoever with false religions where there is unity and alliance from which the difference between faith and infidelity is removed; or any respect, acceptance, belief or union is regarded as correct and permissible or is deemed to be true and proper is absolutely contrary to my faith and belief and is false and is deviation from the right path.
And if for example any Muslim believes in the above mentioned unity, respect and acceptance and does not maintain the boundaries of faith and infidelity then he will definitely, most definitely become an apostate and an infidel and go out of the fold of Islam and will be deserving of hell.
However, accepting the right of the followers of religions of the country to exist, giving them due care and consideration, having regard to them and accepting the rights of other religions to exist by retaining one’s own religious identity, and make joint efforts in the various issues of the nation and to convey the universally revealed message of Islam in a beautiful way among the multi faith gathering and in a joint way play a positive role in rooting out terrorism, rioting and unrest, oppression and violence, killing of innocent people, drugs and addiction, HIV/AIDS, and striving against the enemies of society and the nation and play a positive role in the service of humanity by preaching non-violence, and advocating for a fair and just system is according to me very important which is not contrary to Islam and Sharia. It is with this consideration that I became involved with FUREC.
2. It should be clear that after the communal riots in Gujerat, a multi faith gathering of religious leaders was held in October 2003 to solve the common issues in which Faqir Ashrafi participated as an adviser in which the Surat Spiritual Declaration was established. In June 2004 in New Delhi an organisation called Foundation for the Unity of Religions and Enlightened Citizenship was established which in short is referred to as FUREC. At this initial meeting on the very first day it was agreed that UNITY OF RELIGIONS was to mean the recognition and acceptance of the followers of religions in the joint and common issues of the nation. It should be clear in reference to FUREC that if any of my speeches or written documents or any pamphlet of FUREC refer to the above mentioned words i.e. unity, respect and acceptance then these are to have the meanings that I have mentioned.
Similarly RESPECT OF RELIGIONS should not at all costs be taken to mean ACCEPTANCE OF RELIGIONS because on the very first day from the discussions between the members of FUREC I was completely satisfied and accepted the extent of the definition of respect, acceptance and unity was satisfactory enough for my doubts and concerns. Therefore I did not make any further demands in relation to FUREC. But when some religious minded personalities started to raise baseless accusations in relation to FUREC’s name and objectives then for their satisfaction and removal of any doubt and to try and remove the potential disputes and doubts in future, I sought clarification on this from the FUREC organisation which resulted in not only an explanation and amendment but the Executive Body unanimously made this explanation a part of the Memorandum of Association which is as follows:
Unity among the religions means unity of the followers of religions in making a joint effort in the local and national issues of the country.
If any article or code of Surat Spiritual Declaration (SSD) or the aims & objectives of FUREC clashes with the basic tenet or faith of any religion or followers of religion then that religion or follower of the religion are exempt from joining it.
Respected Uncle God is witness that as soon as this unwanted issue raised its head Faqir Ashrafi without being invited came to your house in Rajjab ul Murajjab 1426 and met with you in the expectation that this issue could be discussed but after the ritual pleasantries I kept returning from Zaawiyat ul Hamza. It should be clear that after I felt in relation to this issue that instead of discussion and mutual consultation and face to face dialogue there was a conspiracy being hatched to heat the atmosphere of mistrust, doubt and suspicion that Faqir Ashrafi reluctantly decided to become a seeker of legal edicts. Which you were aware of in your letter dated 10 October 2005 which for the sake of thoroughness is your first letter with which two unnamed questionnaires seeking legal edicts came with your endorsement. You stated that I should most definitely send the two questionnaires along with your letter – I attached with my questionnaire rising above any gain or loss these documents with my questionnaire and sent them to the Muftis.
4. During this period I learnt that you gave call to and sought the services of your wise and respected elder brother Hazrat Mufakkir e Millat Allama Sayyad Hasan Musanna Anwar Sahib to resolve this unwanted dispute and through his efforts a face to face meeting to discuss this issue was arranged between you and Hazrat Allama Mufti Moeenudin Ashrafi Sanbhali to take place on 8 November. This was agreed on 24 Ramadan ul Mubarak 1426 being 28-10-05. Suddenly on 26 Ramadan ul Mubarak being 31 October 2005 your questionnaire was handed to Allama Mufti Moeenudin Sahib in Kicchocha Sharif. The truth is that your status was to have been an arbitrator not a party to the proceedings and seeker of legal edicts, which resulted in heartfelt anguish for all of us and it is for this reason that I have been unable to answer your letter of 10 October 2005 up until now.
5. In accordance with your recent letter dated 4-2-06 you have arranged a meeting and gathering of only the off springs of Makhdum ul Millat Hazrat Mohaddis e Azam e Hind (whether male or female and those who have a son in law relationship) with this condition attached that in this meeting only the two of us (Sayyid Muhammad Madani Ashrafi Jilani and Sayyid Muhammad Jilani Ashraf) will have a discussion and that there will be no involvement of any Mufti in this discussion. Anyone else who is not a member of the family of Mohaddis e Azam will not be allowed to attend or participate in the meeting.
When the reality is that an issue that should have been resolved within the home has been pulled and stretched and has been turned into a Sharia issue and for one year (Muharram ul Haram 1426 to Muharram ul Haram 1427) in this country and abroad with united and careful planning and entrapment; and by making it a complaint of Sharia it has been spread in house and field, pulpit and mehrab and conference stage and is still continuing (such as is England, Canada, South Africa, Mohaddis e Azam conference in Borsad, Gujerat, India).
What should be given specific attention is that the situation of haste and swiftness, ire and fury has made you stand as a questioner and a party in the court of the Darul Iftas and reluctantly I too have had to become a questionnaire following behind you so that the Muftis would become aware of the truth regarding my views on FUREC.
All praise is for Allah your trusted confidante Hazrat Allama Mufti Moeenudin Ashrafi Sambhali was the first to present an Islamic edict and declare my innocence. Manzare Islam Bareilly Sharif, Jamia Naeemia Muradabad etc have also given their edicts and various other established and respected Darul Iftas and Muftis are sending in their rulings in which my view of Sharia is being clearly endorsed and approved. Resolving this matter is not restricted to the specific group of the family of Mohaddis e Azam, but is related and linked only to the pure Sharia, and in accordance with it my innocence is being proven. And therefore after being cleared in this issue it is no longer required to be discussed and explained in any assembled meeting. Similarly in the current dispute after I have been exonerated whether it is for the sake of thoroughness, or whether in any other meeting or discussion my attendance after the Sharia decisions have been given will be regarded as me not being satisfied with these decisions.
Therefore if respected sir requires increased detail, explanations, proofs and evidence then you should contact all those Muftis who have made a Sharia decision through which they have declared my innocence. Especially your close confidante Mufti and Judge to whom you firstly sent your questionnaire on 31 October 2005 and displayed your complete trust in him and who stayed your chosen and trustworthy one for 12 years in the shrine of Mohaddis e Azam e Hind Kicchocha Sharif’s Darul Ifta as Chief Mufti, in other words Hazrat Allama Mufti Moeenudin Ashrafi. If only you would have discussions with these Muftis and come to a mutual agreement. And if in this meeting there is a requirement for my attendance then I will most definitely attend. But this meeting must be held after 29 Muharram ul Haram 1427 as I am extremely busy with Jamia Sufiya and Spiritual Foundation’s annual function. It will be much better if your meeting with the Muftis takes place at the shrine of Mohaddis e Azam e Hind in Kcchocha Sharif.
May Allah Almighty provide all of us shelter under his umbrella of grace and respect as well as correct guidance and ensure we depart this world with our faith intact.
May the Lord Almighty give us eternal guidance and keep us walking on the right path and keep us steadfast on the Munam Alaihim path. Ameen
Good wisher

SHAYKH AL ISLAM LETTER DATED 14 FEBRUARY 2006
Addressed to Head of Spiritual Foundation
1. On the advice of my respected elder brother, the meeting which I had sought to hold in Borsad is now going to be held in Kicchocha Sharif in the shrine of Hazrat Mohaddis e Azam e Hind (blessings be upon Him) at the date and time which was communicated to you previously, that is 23 February 2006 at 10.00am.
From your recent correspondence I note that you claim that you have received many edicts absolving you of the Sharia charge against you and that you are completely satisfied with these edicts. It is now very easy for you to gather all the edicts and attend the meeting on the agreed date and meet with me and convince me of your innocence.
I am your uncle and you are my nephew. A nephew is like a son and therefore I have the right to ask for your attendance and explanation and it is your compulsory obligation that you satisfy this. This is such an important matter that all other tasks must be put aside so that this can be dealt with.
Respected brother advises me in his letter that:
'to perform this well wished act and important obligation, there is no need for past tales or foolish friends. You alone have to deal with this.'
It is obvious that I can only deal with this when you attend the arranged meeting. As far as the Muftis are concerned, the need I had of them I have fulfilled. I asked them questions and they have given their answers. There is no need for them to be arbitrators or judges – their duty is to provide the legal ruling in Sharia only and that is it. If anyone disagrees with any points raised by the Muftis from a knowledge viewpoint, then they can contact the Muftis directly and seek clarification.
2. My letter and the two Islamic questionnaires still remain with you and therefore bring the answers to these questions with you to the meeting. Respected Rashid Miya informed me that you were going to respond to each and every word of my letter and are busy in its preparation. Hopefully you have now completed this and can bring it to the meeting.
As far as Mufti Moeen is concerned, it is true that at some point I had great confidence in him but he has taken advantage of my simple trust and faith in him and utterly smashed the glass of trust into pieces. I asked him to attend and meet with me on several occasions but he did not attend. I sent him my questionnaire but as yet he has not replied – as my disciple it should have been his common courtesy that before getting involved in this matter he should have come and discussed it with me. But he chose not to do this and putting me to one side he did as he pleased and didn’t even feel the need to have a conversation with me by telephone.
And when I read his written elucidation, instead of a learned and scholarly person, I came to view him as a pygmy.
If you now wish to obtain any assistance from Mufti Moeen, tell him to simply answer my six questions and return the answers to me and that’s it. If I have a difference of opinion with any of his answers, I will contact him directly. At this stage, I have no need to meet with him.
3. Understand with a clear mind that your attendance on 23 February 2006 at the shrine of Hazrat Mohaddis e Azam e Hind (blessing be upon Him) in the Judicial Seminary [Darul Ifta] at 10.00am to discuss this matter face to face with me is absolutely compulsory. If God forbid, a hundred times God forbid you make excuses and do not attend then I will deem it my right to deal with this matter in a way I see fit.
You are telling white lies. You have no written document which absolves you of the Sharia charge against you.
Being a founder member of FUREC the charge of being pleased with infidelity on you means you are powerless to remove the strangulation of this charge on you.
The charge of infidelity with and without knowledge has been accepted by you by your own actions and now means that from confirmed infidelity there is absolute unavoidability.
Being a member of FUREC is unlawful, strictly and absolutely unlawful but you refuse to resign from its membership. And for the wealth of this world you are prepared to destroy completely your hereafter.
Besides false rumours, doubts, mistrust and baseless accusations you have nothing; and are afraid and scared to face the truth and its consequences.
After this I will have full authority and right to deal with you by taking a final and comprehensive decision and whatever consequences arise, you alone will be held responsible – after this letter, there will be no more communication of any kind between you and I; and I will Allah willing, meet with you face to face as per the programme.
